Compensation for Medical Negligence

This section of The Medical Negligence Solicitors details the compensation you can claim if you have been the victim of medical negligence. This is split into two different areas, General Damages and Special Damages which are examined further below.

General Damages

This includes your claim for pain and suffering resulting from the negligence, along with any claim for loss of amenity (what the injury has prevented you from doing following the accident that you used to enjoy). Guidelines help to decide how much compensation you should receive and your solicitor will ensure you receive the right amount of compensation for your pain and suffering.

Special Damages

Special damages include your claim for compensation for your losses and expenses. These can include:

Lost earnings. If you have lost earnings as a result of the accident your solicitor will obtain copies of your payslips before and after the incident to prove your losses. If you are self employed copies of your accounts will be used to support this part of your claim.
Medical Care and Equipment. If you or your child needs help around the home in the form of nursing care or specialist medical equipment, these costs will be included in your claim by your solicitor.
Medication. Any medication required as a result of the medical negligent treatment can also be claimed, again using receipts to prove your losses.
Travel expenses. If as a result of the negligence you have had to take public transport or to travel to hospital appointments, these expenses can be reclaimed using receipts or details of your mileage.
Any other expenses incurred as a direct result of the medical negligence can also be reclaimed.
